Terms and Conditions

1. Introduction

These Terms and Conditions ("Agreement") govern your access to and use of the Achieve Change Grow (ACG) website and platform (the “Platform”)—whether you are a visitor, prospective client, or current client. The Platform may be accessed via www.achievechangegrow.com or other affiliated websites or applications operated by ACG or authorized third parties.

This website is owned and operated by Holistic Psychotherapy & Research, doing business as Achieve Change Grow (ACG).

By accessing or using the Platform, you agree to be bound by this Agreement. Please read it carefully. If you do not agree to any part of this Agreement, do not access or use the ACG website, platform, or services.

References to "we," "us," or "our" refer to ACG and any of its authorized affiliates or operators.

2. Professional Services

The ACG Platform facilitates access to services provided by qualified counselors, psychotherapists, or mentors. All professionals providing services through ACG are required to be HIPAA-compliant, licensed, trained, and accredited in their respective jurisdictions. These may include—but are not limited to—licensed clinical social workers (LCSW), psychologists (PhD/PsyD), licensed marriage and family therapists (LMFT), licensed professional counselors (LPC), or similarly certified professionals.

If a professional is not a good fit for your needs, you may request a reassignment.

3. Telehealth Counseling or Psychotherapy

While we aim to provide helpful services, you acknowledge and agree that online therapy may not be appropriate for all conditions or situations. Telehealth services provided via ACG are not a substitute for in-person care when such care is available or required.

4. Emergencies and Crisis Situations

emergency, immediately call 911 (in the U.S.) or contact local emergency services. The ACG Platform is not designed for use in emergency or high-risk situations, and our providers cannot provide the urgent help required in such cases.

Additionally, ACG services are not intended to provide clinical diagnoses that require in-person evaluations or to offer medical treatment or drug-related advice. You should never delay or disregard seeking in-person medical advice because of information obtained through the ACG Platform.

5. Privacy and Security

Protecting your personal information is a top priority. Please refer to our Privacy Policy for details on how we collect, use, and protect your data.

By agreeing to these Terms and using the Platform, you also agree to the terms of our Privacy Policy, which is incorporated into this Agreement by reference.

6. Third-Party Content

The ACG Platform may contain content, services, or links to third-party websites or advertisements. ACG is not responsible for the content, accuracy, practices, or policies of third-party providers. You assume all risks when interacting with third-party services.

7. Disclaimers and Limitation of Liability

You agree to release and hold harmless ACG from any claims or causes of action arising from services, advice, or interactions on the Platform.

The Platform is provided “as is” without warranties of any kind—express or implied—including but not limited to merchantability, fitness for a particular purpose, non-infringement, security, or accuracy.

To the maximum extent permitted by law, ACG shall not be liable for indirect, incidental, consequential, punitive, or exemplary damages. Our total liability to you shall not exceed the amount you paid via the Platform in the 90 days preceding the date of the claim.

If any part of this section is unenforceable under applicable law, it will be modified to the minimum extent required to be enforceable.

8. User Responsibilities

You agree that:

You are legally capable of entering into this Agreement and, if applicable, have guardian consent.
All information you provide is accurate and up-to-date.
Your use of ACG services is for personal use only.
You will not use the Platform to distribute spam, harmful software, illegal content, or content that infringes on third-party rights.
You will not interfere with ACG’s systems, servers, or networks.

You further agree to indemnify and hold harmless ACG from any claims, damages, or liabilities arising out of:

Your use of the Platform.
Your violation of this Agreement.
Your non-payment for services.
Your infringement of third-party rights.

9. Platform Modifications and Disruptions

We reserve the right to modify, suspend, or discontinue any part of the Platform, with or without notice. While we aim for reliable and continuous access, we cannot guarantee uninterrupted or error-free service.

11. Legal Terms

This Agreement is governed by the laws of your State, without regard to conflict-of-law principles.

You agree that any dispute shall be resolved exclusively in the U.S. District Court for the District of your state. You consent to the personal jurisdiction of these courts and waive any objections to their venue.

This Agreement is the complete agreement between you and ACG. This Agreement supersedes any prior communications or promises.

We may revise this Agreement by posting changes to the ACG website. Updates are effective upon posting. Continued use of the Platform constitutes acceptance of the revised terms.

If any provision is found to be unenforceable, the remaining provisions will remain in effect. All terms relating to limitations of liability and indemnification shall survive the termination of this Agreement.
