This Privacy Policy is a component of our Terms and Conditions. By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to both documents. If you disagree, you must immediately cease use of the Platform or discontinue providing services.

5. Disclaimer of Warranty and Limitation of Liability

You acknowledge and agree:

  • The Platform is provided "as is", with no warranties, express or implied.
     

  • ACG disclaims any liability for the services provided by professionals (e.g., counselors, coaches) via the Platform.
     

  • You release and hold harmless ACG from any claim arising from your use of the Platform or services offered through it.
     

  • ACG’s total liability, if any, shall not exceed the amount paid by you through the Platform within the 90 days preceding the claim.
     

If any limitation is not permitted under applicable law, it will be adjusted to the minimum extent necessary.

6. Your Commitments and Responsibilities

By using the ACG Platform, you affirm and agree:

  • You are legally authorized to enter into this Agreement or have consent from a parent/guardian.
     

  • All information you provide is accurate and kept up to date.
     

  • You will use the Platform only for your personal and lawful purposes.
     

  • You will not attempt to interfere with, hack, or misuse the Platform or its infrastructure.
     

  • You will not submit or transmit:
     

    • Spam or unsolicited content.
       

    • Malicious code or harmful software.
       

    • Unlawful, abusive, or harmful content.
       

    • Content that infringes on third-party rights.
       

You agree to comply with all applicable local, state, and federal laws and codes of conduct. You also agree to:

  • Use only authorized payment methods.
     

  • Pay all applicable fees on time.
     

  • Scan any files received for malicious content.
     

Indemnification

You agree to indemnify and hold harmless ACG from any claims, damages, costs, or losses resulting from:

  • Your use of the Platform.
     

  • Your violation of this Agreement.
     

  • Failure to pay for services.
     

  • Infringement on third-party rights.
     

This clause survives the termination of the Agreement.

7. Modifications, Interruptions, and Disruptions

We reserve the right to modify or suspend Platform access at any time, with or without notice. While we strive for high availability, we cannot guarantee uninterrupted access due to factors beyond our control (e.g., hardware, third-party systems).

8. Notices

9. Legal Jurisdiction and Governing Law

This Agreement is governed by the laws of the State, without regard to conflict-of-law principles. You agree that:

  • All disputes must be resolved in your state or federal courts.
     

You waive any objections to jurisdiction or venue in these courts.

10. Entire Agreement and Amendments

this document, along with the Privacy Policy and Terms and Conditions, constitutes the entire agreement between you and ACG. We may amend the Agreement at any time by posting updates on our Platform. Continued use after any change indicates your acceptance.

We may assign or transfer our rights under this Agreement. If any section is found invalid or unenforceable, the remaining provisions remain in effect.
